General terms and conditions

1. Introduction / Scope

1.1. The following General Terms and Conditions (hereinafter referred to as GTC) of Blecha-Thalhammer Cosmetics GmbH Cosmetics GmbH, FN 547260 w, Billrothstraße 63/8, 1190 Vienna, (hereinafter referred to as Blecha-Thalhammer Cosmetics GmbH), apply to the sale of goods by Blecha-Thalhammer Cosmetics GmbH via the online store (hereinafter referred to as Webshop).

1.2. Blecha-Thalhammer Cosmetics GmbH reserves the right to amend the GTC at any time. The current GTC at the time of the order shall apply to the respective order. Deviating General Terms and Conditions shall not be valid unless Blecha-Thalhammer Cosmetics GmbH confirms acceptance of these deviating General Terms and Conditions in writing in advance.

2. Conclusion of contract and shipment

2.1. The Customer's order constitutes a binding offer. The acceptance of the offer by Blecha-Thalhammer Cosmetics GmbH shall be effected by sending the order confirmation, by delivery of the ordered goods or by collection of the ordered goods by the Customer. Blecha-Thalhammer Cosmetics GmbH shall be entitled to refuse acceptance of the order without stating reasons. The Customer shall be informed of this without delay.

An order process by the customer includes the following steps:

  • Selection of the desired goods
  • Checking the information in the shopping cart
  • Confirmation by clicking the button ”Proceed to checkout”
  • Data input
  • Selection of the payment method
  • Checking the box for the terms and conditions and privacy policy
  • binding dispatch of the order (submission of the offer by the customer)
  • Sending of the order confirmation by e-mail (acceptance).

2.2. The customer is obliged to enter complete and truthful data in the web store.

2.3. Changes or cancellations of orders by the customer can be made in writing. Please write an e-mail to hello@i-really-care.com in this regard. However, these are only valid when confirmed in writing by Blecha-Thalhammer Cosmetics GmbH.

2.4. The shipment is either carried out by Blecha-Thalhammer Cosmetics GmbH or ordered from a shipping partner. Delivery shall be made within a reasonable period after payment or confirmation of receipt of payment during normal business hours to the delivery address entered by the customer.

2.5. Orders from countries that are not available for selection are not possible via the webshop. In this case we ask for a written request to the previously mentioned e-mail address.

3. Prices and shipping costs

3.1. The prices of the goods shown in the webshop are gross prices in Euro and include all taxes and duties for deliveries in Austria. For deliveries outside of Austria, additional costs (especially duties and taxes) may apply.

3.2. Packaging and shipping costs are not included in the gross prices shown. These costs will be calculated and shown separately. Any such costs are to be borne by the customer. The exact shipping costs will be displayed in the shopping cart during the order after correct specification of all necessary data.

4. Payment

4.1. The purchase price is due upon conclusion of the contract. The goods remain the property of Blecha-Thalhammer Cosmetics GmbH until full payment.

4.2. The customer can choose between credit card and PayPal and prepayment when selecting the payment methods.

Credit card

The payment is processed by our payment service provider, SIX Payment Services (Europe) S.A.. (Branch Office Austria). In case of payment by credit card, the charge will be made on the same day.

PayPal

The payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, commercial register number: R.C.S. Luxembourg B 118 349. For the PayPal payment method you need a PayPal account. Your PayPal account will be debited on the same day of the order. Prepayment

After receipt of the full purchase price, the goods will be shipped.

5. Transfer of risk and transport damage

5.1. If the customer is a consumer within the meaning of the Consumer Protection Act (KSchG), use and risk shall pass to the customer as soon as the goods are delivered to the customer or to a third party designated by the customer and different from the shipping partner. If the customer is an entrepreneur, use and risk shall pass to the customer upon delivery of the goods to the shipping partner.

5.2. If the consumer himself concludes the contract of carriage with a shipping service provider, use and risk shall already pass to the shipping service provider upon handover of the goods.

6. Right of withdrawal (right of revocation)

6.1. If the customer is a consumer in the sense of the KSchG, the customer can declare the withdrawal from the purchase contract within 14 days from the day of receipt of the delivery by the customer according to §§ 11 ff Fern- und Auswärtsgeschäfte-Gesetz (FAGG).

6.2. The period for cancellation begins as soon as the consumer acquires possession of the goods (takeover of the goods by the customer or a designated third party). In the case of a multi-part order, the period for cancellation begins as soon as the consumer obtains possession of all the goods (takeover of the last partial shipment by the customer or a designated third party). The day of taking over the goods is not included in the calculation of the time limit.

6.3. To comply with the withdrawal period, it is sufficient that the withdrawal is reported before the expiry of the withdrawal period by e-mail to hello@i-really-care.com, by letter to Blecha-Thalhammer Cosmetics GmbH Cosmetics GmbH, FN 547260 w, Billrothstraße 63/8, 1190 Vienna.

6.4. The right of withdrawal does not apply to goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, provided that their seal has been removed after delivery (e.g. opened packaging). In addition, the right of withdrawal does not apply to consumers who do not belong to a Member State of the European Union at the time of conclusion of the contract and whose sole residence and delivery address are outside the European Union at the time of conclusion of the contract.

6.5. After the withdrawal, the customer is obliged to return the goods within 14 days. Blecha-Thalhammer Cosmetics GmbH will refund the purchase price after written confirmation that the goods have been returned or from receipt of the goods, but only if the goods are undamaged and in their original packaging.
